2011 H1B Visa Cap and Quota - Latest Update

H1B Employers and Sponsor Companies in the USA have now turned to this years H1B Cap 2011 Quota Allocation, as last years 2010 H1B Quota closes.

The latest update issued by the USCIS shows that H1B visas allocated for last years 2010 H1B Cap (quota) have now been filled. H1B visa applications can no longer be filed or processed for last years 2010 visa quota.

New H1B applications can now only be filed and processed for this years 2011 Visa quota (85,000).


Clarification of the Current Availability of H1B visas for the 2011 Cap / Quota

The H1B visa allocation for 2011 is open and 85,000 new visas are available for filing and issuance this year

New H1B visas that will be counted towards the 2011 H1B Quota allocation can be filed by H1B employers and sponsor companies on April 1st 2011 (only 2 months away)

New H1B 2011 visa applications can be filed by either regular processing or by premium processing. H1B premium processing is a faster way to get issued an H1B visa and visas applications can be processed and issued by the USCIS in 15 days. With regular processing the time can take a few months.  

US companies that received Government bail-out money in 2009 and were restricted from sponsoring and filing H1B visas counted towards the H1B cap for 2009 and 2010, can again sponsor and file H1B visas in 2011. This will create extra demand for this years 2011 H1B visa allocation.

US companies that were restricted from sponsoring and filing H1B visas because of the new H1B employer-employee rule establiished in January 2010, are still restricted by the rule in 2011.    

Only 9 Weeks Left Until This Years H1B Visas Can be Filed
For people around the world that want, and, for people in the USA that need an H1B visa from this years 2011 H1B quota: because there is a fixed quota system (limited availability each year) , many of the regular and largest H1B employers and sponsor companies in the USA start recruiting and selecting from January. This helps them eliminate traditional sponsorship risks, allows sufficient time to find and sponsor the best candidates, and makes sure they are fully prepared and ready to file applications early (which safeguards and helps ensure they get issued visas first)



The H1B Cap / Quota system is only for new / first time H1B visa applications
- H1B Transfers are NOT counted towards the annual Cap / quota numbers
- H1B Extensions and Renewals are NOT counted towards the annual Cap / quota numbers
- 'New' H1B visas can also be filed and counted towards the Cap-Exempt H1B Visa Program

* For the above: visas applications can be filed at any time of year and there are no restrictions or quota limitations on the number of visas that can be filed
